甘肅省強化危險廢物監管和

利用處置能力改革工作方案

為進一步(bu)提升全(quan)省危險(xian)廢物監管和利用處置能力,有效防控環(huan)境與安全(quan)風(feng)險(xian),根據《國務(wu)院辦(ban)(ban)公廳關于印(yin)發(fa)強(qiang)化危險(xian)廢物監管和利用處置能力改革實施方案的通知》(國辦(ban)(ban)函〔2021〕47號)精神,結合我省實際,制定本(ben)方案。


一、工作目標

構建(jian)(jian)危(wei)險(xian)廢(fei)(fei)物(wu)(wu)(wu)(醫療廢(fei)(fei)物(wu)(wu)(wu))利用處(chu)置(zhi)(zhi)設施和監(jian)測監(jian)管(guan)(guan)能(neng)(neng)力于一體的環境基(ji)礎設施體系,推動(dong)省域(yu)內危(wei)險(xian)廢(fei)(fei)物(wu)(wu)(wu)(醫療廢(fei)(fei)物(wu)(wu)(wu))處(chu)置(zhi)(zhi)能(neng)(neng)力與產(chan)廢(fei)(fei)情況總體匹(pi)配。強化(hua)安(an)全(quan)監(jian)管(guan)(guan)與環境監(jian)管(guan)(guan)協同聯(lian)動(dong),建(jian)(jian)立健全(quan)源頭嚴(yan)(yan)防、過(guo)程嚴(yan)(yan)管(guan)(guan)、后果嚴(yan)(yan)懲的危(wei)險(xian)廢(fei)(fei)物(wu)(wu)(wu)監(jian)管(guan)(guan)體系。到2022年(nian)(nian)底,危(wei)險(xian)廢(fei)(fei)物(wu)(wu)(wu)非(fei)法轉移傾倒行為得到有(you)效遏制;縣級以上(shang)城(cheng)市建(jian)(jian)成(cheng)區(qu)醫療廢(fei)(fei)物(wu)(wu)(wu)無害化(hua)處(chu)置(zhi)(zhi)率達(da)到99%以上(shang)。到2025年(nian)(nian)底,危(wei)險(xian)廢(fei)(fei)物(wu)(wu)(wu)(醫療廢(fei)(fei)物(wu)(wu)(wu))利用處(chu)置(zhi)(zhi)能(neng)(neng)力進一步提升。


二(er)、重點(dian)任(ren)務

(一(yi))完善危險(xian)廢(fei)物監(jian)管(guan)體制機制。

1.夯實(shi)屬地監管責任(ren)。各(ge)級(ji)人(ren)民政(zheng)(zheng)府(fu)對本行政(zheng)(zheng)區域危(wei)(wei)(wei)險(xian)(xian)廢物(wu)(wu)(醫(yi)療(liao)廢物(wu)(wu))污染環(huan)境(jing)防(fang)治負總責。縣級(ji)以上(shang)人(ren)民政(zheng)(zheng)府(fu)應(ying)當將(jiang)危(wei)(wei)(wei)險(xian)(xian)廢物(wu)(wu)污染環(huan)境(jing)防(fang)治工作納入本地國民經濟(ji)和社會發展(zhan)規(gui)(gui)劃、生(sheng)態環(huan)境(jing)保(bao)護規(gui)(gui)劃統籌推進。在編制(zhi)國土空(kong)間規(gui)(gui)劃和相關專項規(gui)(gui)劃時(shi),應(ying)當統籌危(wei)(wei)(wei)險(xian)(xian)廢物(wu)(wu)(醫(yi)療(liao)廢物(wu)(wu))設施(shi)建(jian)設需求,保(bao)障用地,支持危(wei)(wei)(wei)險(xian)(xian)廢物(wu)(wu)資源化利用和無(wu)害化處(chu)置,最大(da)限度降低危(wei)(wei)(wei)險(xian)(xian)廢物(wu)(wu)填埋量。(各(ge)市州(zhou)(zhou)人(ren)民政(zheng)(zheng)府(fu),蘭(lan)州(zhou)(zhou)新區管委會負責,以下任(ren)務均需各(ge)市州(zhou)(zhou)人(ren)民政(zheng)(zheng)府(fu),蘭(lan)州(zhou)(zhou)新區管委會負責落實(shi),不再列(lie)出)

2.落實部(bu)門監(jian)管(guan)責(ze)任(ren)(ren)。生(sheng)(sheng)(sheng)態(tai)環(huan)(huan)境主管(guan)部(bu)門對危(wei)險廢物(wu)污染(ran)環(huan)(huan)境防治工作實施統一監(jian)督管(guan)理。發(fa)展(zhan)改革、工業和信(xin)(xin)息化、自然(ran)資源、住房城鄉建(jian)(jian)設、交通運輸、衛生(sheng)(sheng)(sheng)健康(kang)、海(hai)關(guan)等單(dan)位在各自職責(ze)范(fan)圍內履行監(jian)督管(guan)理責(ze)任(ren)(ren),完(wan)善部(bu)門間信(xin)(xin)息共享、溝(gou)通協商制(zhi)度,建(jian)(jian)立(li)(li)危(wei)險廢物(wu)全過程監(jian)管(guan)體系。推動省(sheng)(sheng)內相鄰市州建(jian)(jian)立(li)(li)聯防聯控機制(zhi)。市級生(sheng)(sheng)(sheng)態(tai)環(huan)(huan)境主管(guan)部(bu)門應當會同相關(guan)部(bu)門,定期向社會發(fa)布(bu)危(wei)險廢物(wu)的種類、產(chan)生(sheng)(sheng)(sheng)量(liang)、處置(zhi)能力、利用處置(zhi)狀況等信(xin)(xin)息。2022年底前與周(zhou)邊(bian)省(sheng)(sheng)份協商建(jian)(jian)立(li)(li)防范(fan)跨區(qu)域危(wei)險廢物(wu)環(huan)(huan)境風險的合作機制(zhi)。(省(sheng)(sheng)生(sheng)(sheng)(sheng)態(tai)環(huan)(huan)境廳(ting)、省(sheng)(sheng)發(fa)展(zhan)改革委、省(sheng)(sheng)工信(xin)(xin)廳(ting)、省(sheng)(sheng)自然(ran)資源廳(ting)、省(sheng)(sheng)住建(jian)(jian)廳(ting)、省(sheng)(sheng)交通運輸廳(ting)、省(sheng)(sheng)應急廳(ting)、省(sheng)(sheng)衛生(sheng)(sheng)(sheng)健康(kang)委、省(sheng)(sheng)公安廳(ting)、蘭州海(hai)關(guan)等按職責(ze)分工負(fu)責(ze))

3.壓實(shi)企(qi)業主(zhu)(zhu)(zhu)體責(ze)(ze)(ze)(ze)任。危(wei)(wei)(wei)(wei)險(xian)(xian)(xian)廢(fei)(fei)(fei)(fei)(fei)物(wu)(wu)(wu)產(chan)(chan)(chan)(chan)生(sheng)、收集(ji)、貯(zhu)存、運輸(shu)(shu)、利用、處置(zhi)企(qi)業(以(yi)下統(tong)稱危(wei)(wei)(wei)(wei)險(xian)(xian)(xian)廢(fei)(fei)(fei)(fei)(fei)物(wu)(wu)(wu)相關(guan)(guan)(guan)企(qi)業)是危(wei)(wei)(wei)(wei)險(xian)(xian)(xian)廢(fei)(fei)(fei)(fei)(fei)物(wu)(wu)(wu)污染(ran)環(huan)(huan)境(jing)(jing)防治和(he)安全生(sheng)產(chan)(chan)(chan)(chan)法(fa)(fa)定(ding)(ding)責(ze)(ze)(ze)(ze)任主(zhu)(zhu)(zhu)體,危(wei)(wei)(wei)(wei)險(xian)(xian)(xian)廢(fei)(fei)(fei)(fei)(fei)物(wu)(wu)(wu)相關(guan)(guan)(guan)企(qi)業的(de)主(zhu)(zhu)(zhu)要(yao)負(fu)責(ze)(ze)(ze)(ze)人(法(fa)(fa)定(ding)(ding)代表人、實(shi)際控(kong)制(zhi)(zhi)(zhi)人)是第一責(ze)(ze)(ze)(ze)任人。要(yao)嚴(yan)格(ge)按照(zhao)國家有(you)(you)關(guan)(guan)(guan)規(gui)(gui)定(ding)(ding)和(he)環(huan)(huan)境(jing)(jing)保護標準要(yao)求貯(zhu)存、利用、處置(zhi)危(wei)(wei)(wei)(wei)險(xian)(xian)(xian)廢(fei)(fei)(fei)(fei)(fei)物(wu)(wu)(wu),制(zhi)(zhi)(zhi)定(ding)(ding)危(wei)(wei)(wei)(wei)險(xian)(xian)(xian)廢(fei)(fei)(fei)(fei)(fei)物(wu)(wu)(wu)管理(li)(li)(li)計劃,建立危(wei)(wei)(wei)(wei)險(xian)(xian)(xian)廢(fei)(fei)(fei)(fei)(fei)物(wu)(wu)(wu)管理(li)(li)(li)臺(tai)賬,如(ru)實(shi)記(ji)錄(lu)有(you)(you)關(guan)(guan)(guan)信息,并通過危(wei)(wei)(wei)(wei)險(xian)(xian)(xian)廢(fei)(fei)(fei)(fei)(fei)物(wu)(wu)(wu)管理(li)(li)(li)信息系(xi)統(tong)向(xiang)(xiang)(xiang)所在(zai)(zai)地生(sheng)態(tai)(tai)環(huan)(huan)境(jing)(jing)主(zhu)(zhu)(zhu)管部門(men)申報危(wei)(wei)(wei)(wei)險(xian)(xian)(xian)廢(fei)(fei)(fei)(fei)(fei)物(wu)(wu)(wu)的(de)種類、產(chan)(chan)(chan)(chan)生(sheng)量(liang)、流向(xiang)(xiang)(xiang)、貯(zhu)存、處置(zhi)等有(you)(you)關(guan)(guan)(guan)資(zi)料。依(yi)法(fa)(fa)及時(shi)(shi)公開固體廢(fei)(fei)(fei)(fei)(fei)物(wu)(wu)(wu)污染(ran)環(huan)(huan)境(jing)(jing)防治信息,主(zhu)(zhu)(zhu)動接受(shou)社(she)會(hui)監督。嚴(yan)格(ge)執行排污許可管理(li)(li)(li)制(zhi)(zhi)(zhi)度(du)。依(yi)法(fa)(fa)制(zhi)(zhi)(zhi)定(ding)(ding)意外事故的(de)防范措施和(he)應(ying)急(ji)預案(an),并向(xiang)(xiang)(xiang)所在(zai)(zai)地生(sheng)態(tai)(tai)環(huan)(huan)境(jing)(jing)主(zhu)(zhu)(zhu)管部門(men)備(bei)案(an),定(ding)(ding)期(qi)組(zu)(zu)織(zhi)開展應(ying)急(ji)演(yan)練(lian)。危(wei)(wei)(wei)(wei)險(xian)(xian)(xian)廢(fei)(fei)(fei)(fei)(fei)物(wu)(wu)(wu)經營(ying)單(dan)位(wei)(wei)應(ying)當(dang)按照(zhao)國家有(you)(you)關(guan)(guan)(guan)規(gui)(gui)定(ding)(ding)申請取得許可證,貯(zhu)存危(wei)(wei)(wei)(wei)險(xian)(xian)(xian)廢(fei)(fei)(fei)(fei)(fei)物(wu)(wu)(wu)不得超過1年。危(wei)(wei)(wei)(wei)險(xian)(xian)(xian)廢(fei)(fei)(fei)(fei)(fei)物(wu)(wu)(wu)相關(guan)(guan)(guan)企(qi)業,依(yi)法(fa)(fa)依(yi)規(gui)(gui)投(tou)保環(huan)(huan)境(jing)(jing)污染(ran)責(ze)(ze)(ze)(ze)任保險(xian)(xian)(xian)。危(wei)(wei)(wei)(wei)險(xian)(xian)(xian)廢(fei)(fei)(fei)(fei)(fei)物(wu)(wu)(wu)產(chan)(chan)(chan)(chan)生(sheng)和(he)經營(ying)單(dan)位(wei)(wei)定(ding)(ding)期(qi)組(zu)(zu)織(zhi)開展涉危(wei)(wei)(wei)(wei)險(xian)(xian)(xian)廢(fei)(fei)(fei)(fei)(fei)物(wu)(wu)(wu)環(huan)(huan)保設施效(xiao)果和(he)安全評估。嚴(yan)格(ge)落實(shi)危(wei)(wei)(wei)(wei)險(xian)(xian)(xian)廢(fei)(fei)(fei)(fei)(fei)物(wu)(wu)(wu)轉(zhuan)移聯(lian)單(dan)管理(li)(li)(li)制(zhi)(zhi)(zhi)度(du),嚴(yan)禁將危(wei)(wei)(wei)(wei)險(xian)(xian)(xian)廢(fei)(fei)(fei)(fei)(fei)物(wu)(wu)(wu)提(ti)供或委托給(gei)無資(zi)質單(dan)位(wei)(wei)進行收集(ji)、貯(zhu)存和(he)利用處置(zhi)。危(wei)(wei)(wei)(wei)險(xian)(xian)(xian)廢(fei)(fei)(fei)(fei)(fei)物(wu)(wu)(wu)相關(guan)(guan)(guan)企(qi)業以(yi)及各(ge)級產(chan)(chan)(chan)(chan)業基地、化工(gong)(gong)園區等工(gong)(gong)業集(ji)聚區應(ying)當(dang)制(zhi)(zhi)(zhi)定(ding)(ding)危(wei)(wei)(wei)(wei)險(xian)(xian)(xian)廢(fei)(fei)(fei)(fei)(fei)物(wu)(wu)(wu)產(chan)(chan)(chan)(chan)生(sheng)、貯(zhu)存、利用、處置(zhi)等管理(li)(li)(li)清(qing)單(dan),定(ding)(ding)期(qi)組(zu)(zu)織(zhi)摸排危(wei)(wei)(wei)(wei)險(xian)(xian)(xian)廢(fei)(fei)(fei)(fei)(fei)物(wu)(wu)(wu)環(huan)(huan)境(jing)(jing)風險(xian)(xian)(xian),明確整(zheng)改責(ze)(ze)(ze)(ze)任及時(shi)(shi)限,及時(shi)(shi)消除環(huan)(huan)境(jing)(jing)風險(xian)(xian)(xian)隱患。對歷史堆存的(de)各(ge)類危(wei)(wei)(wei)(wei)險(xian)(xian)(xian)廢(fei)(fei)(fei)(fei)(fei)物(wu)(wu)(wu),要(yao)制(zhi)(zhi)(zhi)定(ding)(ding)工(gong)(gong)作方(fang)案(an),采(cai)取有(you)(you)效(xiao)措施限期(qi)完成清(qing)理(li)(li)(li)整(zheng)治,并向(xiang)(xiang)(xiang)省(sheng)(sheng)級生(sheng)態(tai)(tai)環(huan)(huan)境(jing)(jing)主(zhu)(zhu)(zhu)管部門(men)備(bei)案(an)。(省(sheng)(sheng)生(sheng)態(tai)(tai)環(huan)(huan)境(jing)(jing)廳(ting)(ting)、省(sheng)(sheng)公安廳(ting)(ting)、省(sheng)(sheng)交通運輸(shu)(shu)廳(ting)(ting)、甘肅銀(yin)保監局、省(sheng)(sheng)應(ying)急(ji)廳(ting)(ting)、省(sheng)(sheng)衛(wei)生(sheng)健康委等部門(men)按職責(ze)(ze)(ze)(ze)分工(gong)(gong)負(fu)責(ze)(ze)(ze)(ze))

4.完善危險廢(fei)物環境(jing)(jing)管理信息(xi)化體系。危險廢(fei)物相關企業應依(yi)法報送相關信息(xi),并(bing)對(dui)信息(xi)的(de)真實(shi)性(xing)、準(zhun)確性(xing)和(he)完整(zheng)性(xing)負(fu)責,實(shi)現危險廢(fei)物產生情(qing)況在線申報、管理計劃(hua)在線備案(an)、轉移聯單在線運行(xing)(xing)、利用處置情(qing)況在線報告。推動(dong)危險廢(fei)物管理信息(xi)在日常環境(jing)(jing)監(jian)管、執法檢查、排污許可和(he)環境(jing)(jing)統計等(deng)環節中(zhong)的(de)應用。在有條件的(de)地區逐步(bu)推行(xing)(xing)視頻監(jian)控(kong)、電(dian)子標(biao)簽等(deng)集(ji)成智能監(jian)控(kong)。(省(sheng)生態環境(jing)(jing)廳、省(sheng)財政廳、省(sheng)交通運輸廳、省(sheng)衛生健康委(wei)等(deng)按職責分工負(fu)責)


(二)強(qiang)化(hua)危險廢物源頭管控(kong)。

5.加強(qiang)危(wei)(wei)險廢(fei)物鑒(jian)別(bie)(bie)(bie)(bie)管理(li)。落實危(wei)(wei)險廢(fei)物產生單(dan)位對危(wei)(wei)險廢(fei)物鑒(jian)別(bie)(bie)(bie)(bie)的主體責任,危(wei)(wei)險廢(fei)物鑒(jian)別(bie)(bie)(bie)(bie)單(dan)位對鑒(jian)別(bie)(bie)(bie)(bie)報(bao)告內容和鑒(jian)別(bie)(bie)(bie)(bie)結(jie)論負(fu)(fu)責并承(cheng)擔(dan)相(xiang)應責任。歷史遺留無(wu)法查明責任主體的固(gu)體廢(fei)物,由屬地(di)縣級(ji)人民政(zheng)府(fu)負(fu)(fu)責鑒(jian)別(bie)(bie)(bie)(bie)和處置。組(zu)建(jian)省(sheng)級(ji)危(wei)(wei)險廢(fei)物鑒(jian)別(bie)(bie)(bie)(bie)專家委員會,強(qiang)化危(wei)(wei)險廢(fei)物鑒(jian)別(bie)(bie)(bie)(bie)技術指(zhi)導(dao),對危(wei)(wei)險廢(fei)物鑒(jian)別(bie)(bie)(bie)(bie)報(bao)告開(kai)展抽查復核(he),及(ji)時向社會公開(kai)鑒(jian)別(bie)(bie)(bie)(bie)信息(xi)。(省(sheng)生態環境(jing)廳負(fu)(fu)責)

6.嚴(yan)(yan)格環(huan)境(jing)準入。落實(shi)“三線一單(dan)”分區管控要求,在(zai)生態保(bao)(bao)護(hu)紅(hong)線區、永久(jiu)基(ji)本農田(tian)集(ji)中區和(he)(he)其他需要特別保(bao)(bao)護(hu)的區域(yu)內,禁(jin)止建(jian)(jian)設危(wei)(wei)險(xian)廢物集(ji)中貯存(cun)、利用處(chu)置(zhi)設施和(he)(he)場所。新建(jian)(jian)項目要嚴(yan)(yan)格執行(xing)《建(jian)(jian)設項目危(wei)(wei)險(xian)廢物環(huan)境(jing)影(ying)響評價(jia)指南》《危(wei)(wei)險(xian)廢物處(chu)置(zhi)工程技術導則(ze)》,對危(wei)(wei)險(xian)廢物產生量大、低價(jia)值、難(nan)處(chu)理(li),本省無(wu)配(pei)套利用處(chu)置(zhi)能力的項目從嚴(yan)(yan)審批。加大涉危(wei)(wei)險(xian)廢物重點(dian)行(xing)業建(jian)(jian)設項目環(huan)境(jing)影(ying)響評價(jia)文件抽查復核,建(jian)(jian)立問題清單(dan)和(he)(he)整改措施并推動落實(shi)。依法將固(gu)體(ti)廢物納入排(pai)污(wu)許可(ke)管理(li)。嚴(yan)(yan)肅查處(chu)“未批先建(jian)(jian)”、“批建(jian)(jian)不(bu)符”、無(wu)證排(pai)污(wu)、不(bu)按證排(pai)污(wu)等(deng)違法行(xing)為。(省生態環(huan)境(jing)廳負(fu)責)

7.推動(dong)源(yuan)(yuan)頭減量(liang)化。支持研發、推廣減少危險(xian)廢(fei)物(wu)產(chan)(chan)生(sheng)(sheng)(sheng)量(liang)和降低(di)危害(hai)性的生(sheng)(sheng)(sheng)產(chan)(chan)工(gong)藝和設(she)備,鼓勵產(chan)(chan)廢(fei)企業(ye)內部(bu)資源(yuan)(yuan)化利用。加強(qiang)“雙超雙有”企業(ye)和“兩高”項目強(qiang)制性清(qing)潔(jie)生(sheng)(sheng)(sheng)產(chan)(chan)審核,推動(dong)危險(xian)廢(fei)物(wu)經營單位和年產(chan)(chan)生(sheng)(sheng)(sheng)量(liang)100噸以(yi)上(shang)的危險(xian)廢(fei)物(wu)產(chan)(chan)生(sheng)(sheng)(sheng)單位開展清(qing)潔(jie)生(sheng)(sheng)(sheng)產(chan)(chan)審核。(省工(gong)信廳、省科技廳、省生(sheng)(sheng)(sheng)態環境廳等(deng)按(an)職責分(fen)工(gong)負責)


(三(san))強化(hua)危險(xian)廢物(wu)收集轉(zhuan)運過程監管。

10.加(jia)強轉(zhuan)移審批(pi)監(jian)管(guan)(guan)。危(wei)險(xian)廢(fei)物(wu)(wu)轉(zhuan)移推行就近原則(ze),加(jia)強以焚(fen)燒、填埋等方式(shi)處置的危(wei)險(xian)廢(fei)物(wu)(wu)跨(kua)省(sheng)轉(zhuan)入管(guan)(guan)理。落實危(wei)險(xian)廢(fei)物(wu)(wu)跨(kua)省(sheng)轉(zhuan)移“白名單(dan)”制(zhi)度(du)。維護(hu)危(wei)險(xian)廢(fei)物(wu)(wu)跨(kua)區域轉(zhuan)移公平競爭市場秩序,不(bu)得設置不(bu)合理行政壁壘(lei)。(省(sheng)生態環(huan)境廳負責)

11.嚴(yan)厲打擊(ji)涉危險(xian)廢物(wu)違法(fa)(fa)犯罪行(xing)(xing)為(wei)。強化行(xing)(xing)政執法(fa)(fa)與(yu)(yu)刑事司法(fa)(fa)、檢察公益訴(su)訟的協調聯動,加(jia)強行(xing)(xing)刑銜接與(yu)(yu)公益訴(su)訟檢察監督(du),推動生(sheng)(sheng)(sheng)態(tai)環(huan)(huan)境(jing)(jing)損(sun)害(hai)(hai)與(yu)(yu)檢察公益訴(su)訟銜接配合,落實生(sheng)(sheng)(sheng)態(tai)環(huan)(huan)境(jing)(jing)損(sun)害(hai)(hai)賠償(chang)制(zhi)度(du)。嚴(yan)厲打擊(ji)非法(fa)(fa)排放、傾倒(dao)、收集、貯(zhu)存、轉移、利用、處(chu)置危險(xian)廢物(wu)等(deng)環(huan)(huan)境(jing)(jing)違法(fa)(fa)犯罪行(xing)(xing)為(wei),落實有獎舉報制(zhi)度(du),鼓(gu)勵公眾參與(yu)(yu)監督(du)。對未按照許可(ke)證規定從(cong)事收集、貯(zhu)存、利用、處(chu)置危險(xian)廢物(wu)經營(ying)活動的,由生(sheng)(sheng)(sheng)態(tai)環(huan)(huan)境(jing)(jing)主管部門責(ze)令改正(zheng),限(xian)制(zhi)生(sheng)(sheng)(sheng)產、停產整(zheng)治,依(yi)法(fa)(fa)對相關單位和責(ze)任人予以處(chu)罰,情節嚴(yan)重(zhong)的,報經有批準權(quan)的人民政府批準,責(ze)令停業(ye)或者(zhe)關閉。對危險(xian)廢物(wu)不能及時(shi)利用處(chu)置的生(sheng)(sheng)(sheng)產和經營(ying)單位,督(du)促其限(xian)期利用處(chu)置,對自查自糾(jiu)并及時(shi)妥善處(chu)置歷(li)史遺(yi)留危險(xian)廢物(wu)的單位,依(yi)法(fa)(fa)從(cong)輕(qing)處(chu)罰。(省(sheng)(sheng)法(fa)(fa)院、省(sheng)(sheng)檢察院、省(sheng)(sheng)公安(an)廳(ting)(ting)、省(sheng)(sheng)生(sheng)(sheng)(sheng)態(tai)環(huan)(huan)境(jing)(jing)廳(ting)(ting)、省(sheng)(sheng)交通(tong)運輸廳(ting)(ting)、省(sheng)(sheng)水利廳(ting)(ting)、省(sheng)(sheng)衛生(sheng)(sheng)(sheng)健康委等(deng)按職責(ze)分工負(fu)責(ze))


(四)強化廢棄危險化學品(pin)監管。

(五(wu))提升危(wei)險廢物(wu)集中處置基礎(chu)保障能力(li)。

13.落(luo)實國家特(te)殊類(lei)別危險廢物處(chu)置設(she)(she)施建(jian)設(she)(she)規(gui)劃布(bu)局。按照國家統(tong)一(yi)部(bu)署,積極謀劃我省(sheng)特(te)殊類(lei)別危險廢物焚燒、填埋處(chu)置基地建(jian)設(she)(she)項目。(省(sheng)財政(zheng)廳、省(sheng)自然資源廳、省(sheng)生態環境廳、省(sheng)住(zhu)建(jian)廳等按職責分工負責)

14.實現省(sheng)域內(nei)危(wei)(wei)險廢(fei)物(wu)處置能(neng)力與(yu)產廢(fei)情(qing)況(kuang)總(zong)體匹配。加強(qiang)危(wei)(wei)險廢(fei)物(wu)集中利用(yong)處置設施(shi)建(jian)(jian)(jian)設,推(tui)動全(quan)省(sheng)危(wei)(wei)險廢(fei)物(wu)利用(yong)處置能(neng)力與(yu)產廢(fei)情(qing)況(kuang)總(zong)體匹配。對產能(neng)過(guo)(guo)剩的危(wei)(wei)險廢(fei)物(wu)利用(yong)處置項目(mu),鼓(gu)勵企業(ye)(ye)通過(guo)(guo)兼(jian)并重組、產業(ye)(ye)技(ji)術升級改造(zao)等方(fang)式做大(da)做強(qiang),開展規模化、專業(ye)(ye)化建(jian)(jian)(jian)設運(yun)營服(fu)務。(省(sheng)財政(zheng)廳(ting)、省(sheng)自然資源廳(ting)、省(sheng)生態(tai)環境廳(ting)、省(sheng)住建(jian)(jian)(jian)廳(ting)等按職責分工負責)


(六(liu))促進危險廢物利用處置產業高質量發展。

15.促進危(wei)險(xian)(xian)(xian)(xian)廢物(wu)利用處置(zhi)(zhi)企業規(gui)模化發展、專業化運營。定期發布危(wei)險(xian)(xian)(xian)(xian)廢物(wu)相關信(xin)息,科學引導危(wei)險(xian)(xian)(xian)(xian)廢物(wu)利用處置(zhi)(zhi)產業發展。新建(jian)危(wei)險(xian)(xian)(xian)(xian)廢物(wu)(醫療廢物(wu)除外)集中焚(fen)燒(shao)處置(zhi)(zhi)設施處置(zhi)(zhi)能力原(yuan)則上應(ying)大于(yu)3萬噸/年。從嚴控制(zhi)危(wei)險(xian)(xian)(xian)(xian)廢物(wu)柔性填(tian)埋場建(jian)設規(gui)模,有效(xiao)降低可焚(fen)燒(shao)減量(liang)(liang)的危(wei)險(xian)(xian)(xian)(xian)廢物(wu)填(tian)埋量(liang)(liang)。鼓(gu)勵(li)(li)產業集聚區和(he)年產廢量(liang)(liang)或貯存量(liang)(liang)大于(yu)1萬噸的企業配套建(jian)設危(wei)險(xian)(xian)(xian)(xian)廢物(wu)利用處置(zhi)(zhi)設施。適(shi)度(du)發展水泥窯、工(gong)業窯爐(lu)協同(tong)處置(zhi)(zhi)危(wei)險(xian)(xian)(xian)(xian)廢物(wu)(醫療廢物(wu))。鼓(gu)勵(li)(li)建(jian)設垃圾焚(fen)燒(shao)飛灰(hui)、廢鹽(yan)、大修渣等(deng)省(sheng)內(nei)暫無能力的危(wei)險(xian)(xian)(xian)(xian)廢物(wu)利用處置(zhi)(zhi)設施和(he)項目。(省(sheng)生態環境廳等(deng)按職責(ze)分工(gong)負責(ze))

16.規范危(wei)險(xian)廢物(wu)利(li)用(yong)(yong)(yong)。綜合(he)利(li)用(yong)(yong)(yong)危(wei)險(xian)廢物(wu)應當(dang)遵(zun)守國(guo)家(jia)相關(guan)法律法規,符合(he)危(wei)險(xian)廢物(wu)污染環境防治(zhi)技術標準(zhun)(zhun),使(shi)用(yong)(yong)(yong)危(wei)險(xian)廢物(wu)綜合(he)利(li)用(yong)(yong)(yong)產物(wu)應當(dang)符合(he)國(guo)家(jia)規定的用(yong)(yong)(yong)途和(he)標準(zhun)(zhun)。探索開展(zhan)工(gong)業(ye)(ye)企(qi)業(ye)(ye)利(li)用(yong)(yong)(yong)危(wei)險(xian)廢物(wu)替代(dai)生(sheng)產原料“點(dian)(dian)對點(dian)(dian)”定向利(li)用(yong)(yong)(yong)許可證豁免管(guan)理試(shi)點(dian)(dian)。(省生(sheng)態(tai)環境廳(ting)(ting)、省工(gong)信廳(ting)(ting)、省農業(ye)(ye)農村(cun)廳(ting)(ting)、省市場監管(guan)局等按職責分工(gong)負(fu)責)

(七)建立平戰結合的應急處置體系。

19.完善醫療(liao)(liao)廢物(wu)和(he)危(wei)險(xian)廢物(wu)應(ying)(ying)急處置機制(zhi)。縣級以上人民政府應(ying)(ying)將醫療(liao)(liao)廢物(wu)收集、貯存、運輸、處置等工作(zuo)納入(ru)重大(da)傳染病疫情(qing)領導指(zhi)揮體系,強化統籌協調,保障(zhang)所(suo)需(xu)車輛、場地、處置設(she)施和(he)防護物(wu)資。將涉及危(wei)險(xian)廢物(wu)突(tu)發(fa)生(sheng)態環境事件應(ying)(ying)急處置納入(ru)政府應(ying)(ying)急響(xiang)應(ying)(ying)體系,制(zhi)定完善環境應(ying)(ying)急響(xiang)應(ying)(ying)預案,定期開展(zhan)應(ying)(ying)急演練。(省衛生(sheng)健(jian)康(kang)委、省生(sheng)態環境廳、省住建(jian)廳、省交(jiao)通運輸廳、省公安廳等按職(zhi)責分工負責)

20.提升(sheng)醫(yi)療(liao)廢(fei)物處(chu)(chu)置能(neng)力。縣級以(yi)上人民政(zheng)府應加(jia)強醫(yi)療(liao)廢(fei)物集中處(chu)(chu)置能(neng)力建設(she)(she),各市州應至少具備(bei)1個(ge)符合運行要(yao)求的醫(yi)療(liao)廢(fei)物集中處(chu)(chu)置設(she)(she)施。2022年6月底前,各縣市、區建成醫(yi)療(liao)廢(fei)物收集轉運處(chu)(chu)置體系。鼓勵發展移動式醫(yi)療(liao)廢(fei)物處(chu)(chu)置設(she)(she)施,為偏遠基層提供(gong)就(jiu)地處(chu)(chu)置服務。(省生(sheng)態環境(jing)廳、省衛生(sheng)健康委(wei)等按職責分工負責)

(八(ba))強(qiang)化危險(xian)廢物環(huan)境(jing)風(feng)險(xian)防控能力。

22.加強(qiang)專(zhuan)業監(jian)(jian)管(guan)和應急隊伍建設(she)(she)。建立健全省市兩級危險(xian)廢物(wu)環(huan)境監(jian)(jian)管(guan)和技(ji)術(shu)(shu)支撐(cheng)(cheng)體系(xi),加強(qiang)綜合執法隊伍和能力建設(she)(she),配備必(bi)要的(de)危險(xian)廢物(wu)監(jian)(jian)管(guan)人員和技(ji)術(shu)(shu)裝備,切實提升危險(xian)廢物(wu)環(huan)境監(jian)(jian)管(guan)和風險(xian)防控能力。鼓勵有條件的(de)地區,采取政府(fu)購買服(fu)務等(deng)方式,引入(ru)第三(san)方企業開(kai)展(zhan)危險(xian)廢物(wu)規范化(hua)環(huan)境管(guan)理(li)評估技(ji)術(shu)(shu)服(fu)務,為環(huan)境監(jian)(jian)管(guan)提供技(ji)術(shu)(shu)支撐(cheng)(cheng)。(省生態(tai)環(huan)境廳、省委編辦等(deng)按職責分工負責)

23.落實完善法(fa)規(gui)制度。落實新修訂的《中華(hua)人民共和國(guo)固(gu)體廢物(wu)(wu)污染(ran)環(huan)(huan)境(jing)(jing)防(fang)治法(fa)》《甘(gan)(gan)肅(su)省(sheng)固(gu)體廢物(wu)(wu)污染(ran)環(huan)(huan)境(jing)(jing)防(fang)治條(tiao)例》,制定(ding)出臺《甘(gan)(gan)肅(su)省(sheng)危險廢物(wu)(wu)經(jing)營許可審(shen)查評估(gu)技(ji)術細則》《甘(gan)(gan)肅(su)省(sheng)危險廢物(wu)(wu)轉移審(shen)查管(guan)理(li)流程》等制度。鼓勵各地(di)結合實際制定(ding)完善危險廢物(wu)(wu)(醫療廢物(wu)(wu))相關管(guan)理(li)制度和地(di)方(fang)標準。(省(sheng)生態環(huan)(huan)境(jing)(jing)廳、省(sheng)司法(fa)廳、省(sheng)交通運輸廳、省(sheng)市場(chang)監管(guan)局等按職責(ze)分工(gong)負責(ze))

24.加強重點環(huan)保設(she)施(shi)(shi)安(an)全風(feng)險評(ping)(ping)估(gu)論證。針(zhen)對近年來的事(shi)故情況,組織(zhi)開(kai)展(zhan)企(qi)業(ye)涉危廢環(huan)保設(she)施(shi)(shi)的全面摸排,建(jian)立臺(tai)賬。督促(cu)企(qi)業(ye)自行或委托第三(san)方(fang)開(kai)展(zhan)安(an)全評(ping)(ping)估(gu),根據評(ping)(ping)估(gu)結果(guo),形成問(wen)題清單,制定(ding)防范措施(shi)(shi)并組織(zhi)實施(shi)(shi)。組織(zhi)開(kai)展(zhan)對評(ping)(ping)估(gu)和(he)治(zhi)理結果(guo)的監督檢查(cha),對不(bu)落實評(ping)(ping)估(gu)要求和(he)方(fang)法(fa)措施(shi)(shi)的,嚴肅依法(fa)查(cha)處。(省(sheng)生態環(huan)境廳(ting)、省(sheng)應急廳(ting)等(deng)按職責(ze)分工(gong)負責(ze))

25.提升(sheng)基(ji)礎(chu)研(yan)(yan)究能(neng)力。加強(qiang)危(wei)(wei)險(xian)(xian)廢(fei)物環(huan)境風(feng)險(xian)(xian)識別(bie)與控制機理研(yan)(yan)究、危(wei)(wei)險(xian)(xian)廢(fei)物風(feng)險(xian)(xian)防控與利(li)用(yong)處置(zhi)等基(ji)礎(chu)研(yan)(yan)究,推動科研(yan)(yan)成果轉化應用(yong)。加強(qiang)危(wei)(wei)險(xian)(xian)廢(fei)物和化學品測試分析能(neng)力、環(huan)境風(feng)險(xian)(xian)防控、評估(gu)技(ji)術和污染控制技(ji)術能(neng)力建設,提升(sheng)危(wei)(wei)險(xian)(xian)廢(fei)物環(huan)境風(feng)險(xian)(xian)預警與管理決(jue)策水平。(省(sheng)科技(ji)廳、省(sheng)教育廳、省(sheng)生(sheng)態(tai)環(huan)境廳等按職責分工(gong)負責)

26.加強教育培(pei)訓(xun)(xun)。依托具備條件的相(xiang)關企(qi)業建(jian)設培(pei)訓(xun)(xun)實習基地,通過專家(jia)授課(ke)、現場觀(guan)摩交流等多種方(fang)式,加強技(ji)術(shu)培(pei)訓(xun)(xun)。組建(jian)危險廢物(wu)環境(jing)管(guan)理專家(jia)團隊,為危險廢物(wu)環境(jing)管(guan)理和污染防治提(ti)供(gong)技(ji)術(shu)支撐。(省生態(tai)環境(jing)廳(ting)負責)


三、保障措施

(一)強化組織領(ling)(ling)導。縣級以(yi)上人民政府(fu)將危(wei)險廢(fei)物污染環境(jing)(jing)(jing)防治(zhi)情(qing)況(kuang)納入環境(jing)(jing)(jing)狀況(kuang)和(he)環境(jing)(jing)(jing)保護(hu)目標(biao)完(wan)成情(qing)況(kuang)年度報告,并向本級人民代表(biao)大(da)會或者人民代表(biao)大(da)會常務委員會報告。各級職能部門(men)按(an)照(zhao)職責(ze)分(fen)工(gong)嚴格(ge)履行危(wei)險廢(fei)物監管(guan)責(ze)任(ren),加強工(gong)作協同聯動。建立危(wei)險廢(fei)物污染環境(jing)(jing)(jing)防治(zhi)目標(biao)責(ze)任(ren)制和(he)考核(he)(he)評價制度,將危(wei)險廢(fei)物污染環境(jing)(jing)(jing)防治(zhi)目標(biao)完(wan)成情(qing)況(kuang)、危(wei)險廢(fei)物規范(fan)化環境(jing)(jing)(jing)管(guan)理評估情(qing)況(kuang)納入污染防治(zhi)攻堅戰考核(he)(he),并作為考核(he)(he)評價黨政領(ling)(ling)導班子和(he)有關領(ling)(ling)導干(gan)部的重(zhong)要參考。(省生態環境(jing)(jing)(jing)廳和(he)相關部門(men)按(an)職責(ze)分(fen)工(gong)負(fu)責(ze))
